at 1860 Main Street in Springfield. Police ID fatal pellet shooter The police statement described the chaos around Fenway and Kenmore Square as the crowd turned from celebratory to violent after the Red Sox pennant victory. By THEO EMERY Associated Press fans who flocked to Kenmore Square, and Fenway Park when the Red Sox beat the New York Yankees for the American League pen- BOSTON Police publicly identified for the first time yesterday the officer who fired a pepper-spray pellet into a crowd of celebrating Boston Red Sox fans, fatally injuring an Emerson College student. Officer Rochefort Milien fired his pepper-spray pellet gun at a fan during the Oct. 21 disturbance, but missed and instead hit Victoria Snelgrove, 21, police said in an update of the investigation into her death.

The shot hit Snelgrove in the eye, fatally injuring her. Snelgrove, a journalism major from East Bridgewater, was among thousands of college-age Victoria Victoria nant. Messages Snelgrove left for police union officials were not immediately returned last night. The investigation indicates that at least four people were hit by the projectiles, including Snelgrove. Officer Milien, a grenadier assigned to the police Special Operations unit, is certified to train officers in the use of the Police spokesman David Estrada said there would be no further police comment beyond the statement.

The police statement, which Estrada described as an update of the police investigation into the death, described chaos around Fenway and Kenmore Square as the crowd turned from celebratory to violent, attacking cars, throwing debris at police and lighting fires as the night wore on. The statement described how fans attacked a car trying to turn down Landsdowne Street from Brookline Avenue. The crowd surrounded another vehicle as it left a commercial garage, trying to flip the vehicle with the occupants still inside, crushing in the roof and smashing the windshield. When a unit on horseback came to the occupants' rescue, allowing them to get to safety, the crowd then turned its attention to the mounted police, throwing coins, burning paper, bottles and other debris at the police and the horses. One horse's tail was burned when it was struck by flaming debris.

Deputy Superintendent Robert E. O'Toole Jr. authorized the use of the pellet guns known as the FN303, which is made by FN Herstal. He fired the weapons at specific individuals, as did Officers Samil Silta and Milien. Milien's weapon hit Snelgrove, who was about 25 to 30 feet away.

"Victoria Snelgrove was not the targeted; projectile she was missed struck its when tended target," the statement said. Yesterday, The Boston Globe reported that O'Toole was not certified to use the FN303, contradicting statements from O'Toole's lawyer that he was certified and "eminently qualified" to use the weapon. The BPD purchased the FN303 guns to assist with controlling protests during the Democratic National Convention last summer, but had not used them in crowd-control situations outside training before the Fenway Park shootings. Civil rights advocates angry over Snelgrove's death are circulating petitions seeking a temporary ban on the department's use of the so-called lesslethal weapons. Police officials since have suspended their use pending the outcome of the investigation.

Briefs Elder's license sought in veteran's death WHITMAN Police yesterday asked the state Registry of Motor Vehicles to consider pulling the driver's license of an elderly man whose van fatally struck a World War II veteran during a parade. William Hammond, 80, of Abington, was struck as he lined up with fellow veterans at the start of the Veterans Day parade Thursday in Whitman. Police have not filed charges against the driver, 80-year-old Joseph E. Davis of East Bridgewater, but asked the RMV to conduct an "immediate threat" assessment, according to deputy chief Raymond Nelson. Thrift store remains tentatively identified BRIDGEPORT, Conn.

Police believe that the remains of a human body that were discovered in a thrift store's chimney Thursday belong to a man who was reported missing back in 1999. Bridgeport police are waiting for autopsy results to confirm the man's identity. The decomposed body of a man was found Thursday in a chimney at Salvation Army by a worker doing repairs on a furnace. Among the parts removed were clothing remnants, a thigh bone and a knee bone, and a few personal belongings, which has helped them make the tentative identification. AG: Doctor gouged patients for flu shots HARTFORD Attorney General Richard Blumenthal yesterday accused a Fairfield County physician of doubling his prices to gouge patients trying to get a hard-to-find flu shot.

In a lawsuit to be filed in Hartford Superior Court, Blumenthal accuses physician Robert Gabriel of Convenient Medical Care Center in Riverside of raising his price from $50 to $100 a dose for the flu vaccine when a shortage was announced last month. Blumenthal said Gabriel made about $70 profit on each dose administered. In addition to Gabriel and his practice, the lawsuit names Gabriel's assistant, Raymond N. Mott and Mott's son, Raymond N. Mott III.

Blumenthal said the elder Mott arranged to purchase flu vaccine from his son, who operates House Calls of New York, a mobile medical practice based in New Windsor, N.Y. 5th-grader's honesty uncovers warrants BELLOWS FALLS, Vt. A 10-year-old has been honored for his honesty in returning $180 in cash to a dishonest man. Patrick Corkins, a fifth-grade pupil at Newport City Elementary School in Vermont, found a wallet with the cash in the parking lot of the Miss Bellows Falls Diner Oct. 30 after having breakfast with his grandparents.

The wallet belonged to Michael Zawistoski, a Bellows Falls man who police later discovered had two warrants out' for his arrest. According to Bellows Falls Police Chief Keith Clark, the boy returned the wallet before Zawistoski even knew it was missing. Conn. emissions testing resumes HARTFORD Seven months after questions and concerns about accuracy and honesty shut down the state's motor vehicle emissions testing program, hundreds of cars lined up to be tested as the program resumed yesterday. The testing program resumed at about.

260 service stations around the state. At midday yesterday, the number of cars that had been tested statewide was 1,340, according to Bill Seymour, spokesman for the state Department of Motor Vehicles.
